WHATSAPP CHANNEL ADDENDUM

This WhatsApp Channel Addendum (the "Addendum") is a binding contract between you and MAJORITY USA, LLC ("MAJORITY", "we", "us", or "our"). It governs your use of the WhatsApp messaging platform to interact with Simon AI, manage your MAJORITY account, and initiate transactions (the "WhatsApp Channel").

By Linking your WhatsApp account or interacting with us via WhatsApp, you agree to this Addendum.

1. The Channel vs. the Services

The WhatsApp Channel is strictly a user interface. It is not a standalone financial product. All financial activities, money transfers, and account management actions you initiate via WhatsApp remain fully governed by your existing agreements with us and our partners, including the applicable terms of service, cardholder agreements, and payment services that govern your specific account and the services you access (collectively, the "Underlying Agreements"). If there is a conflict between this Addendum and the Underlying Agreements, this Addendum controls only regarding your use of the WhatsApp Channel itself.

2. Authorization and Security

Because the WhatsApp Channel does not use standard app login screens, possession of your mobile device and WhatsApp account is your primary authentication.

  1. Authorized Instructions: You agree that any instruction, confirmation, or request sent to us from your verified WhatsApp phone number is authorized by you and legally binding. We are not required to further verify the identity of the person sending instructions from your WhatsApp account.
  2. Account Security: You are solely responsible for maintaining the security of your mobile device, your WhatsApp login codes, and any 2-factor authentication PINs. If you share your device or WhatsApp account with someone else, you are responsible for any transactions they initiate.
  3. Lost or Compromised Devices: You must notify us immediately by emailing [email protected] or contacting Customer Support through the MAJORITY application or website if you believe your phone has been lost or stolen, or if your WhatsApp account has been compromised.

3. Electronic Communications (E-Sign Consent)

By using the WhatsApp Channel, you affirmatively consent to receive legally required notices, disclosures, transaction receipts, one-time passcodes (OTPs), and other communications from us electronically via WhatsApp. You agree that these electronic communications satisfy any legal requirement that such communications be in writing.

To access and retain these communications, you must maintain an active mobile device running the WhatsApp application, an internet connection, and the ability to view standard document files (like PDFs).

4. Mobile Messaging and Consent

The WhatsApp Channel operates via automated messages (chatbots) and live agent support.

  1. Transactional Messages: By initiating a conversation with us, you consent to receive automated and manual transactional messages necessary to provide the service (such as receipts, balance inquiries, and security alerts). You will receive these messages as long as you use the WhatsApp Channel. Your mobile carrier’s standard data rates may apply to your use of the WhatsApp Channel.
  2. Marketing Messages: If you explicitly opt-in to receive promotional messages, we may send you marketing alerts via WhatsApp. You may opt out of these marketing messages at any time by replying "STOP".
  3. Termination of Channel: Replying "STOP"will opt you out of marketing messages. If you wish to entirely stop using the WhatsApp Channel for transaction features, you may simply stop messaging us or use the native WhatsApp "Block" feature.

5. Privacy and Data Sharing

By using the WhatsApp Channel, you acknowledge that your communications are routed through servers owned by Meta Platforms, Inc. Therefore, the transmission of your data is subject to Meta’s Privacy Policy in addition to the applicable MAJORITY Privacy Policy governing your account. You consent to the sharing of your phone number and chat metadata with Meta to facilitate this service.

6. Third-Party Platform Disclaimer

You acknowledge that WhatsApp is a third-party platform owned and operated by Meta Platforms, Inc., which is not affiliated with MAJORITY. Your use of the WhatsApp application is governed by WhatsApp’s own Terms of Service and Privacy Policy.

MAJORITY IS NOT RESPONSIBLE OR LIABLE FOR:

  1. The functionality, availability, or uptime of the WhatsApp platform;
  2. Any delays or delivery failures of messages caused by WhatsApp or your internet/telecom provider; or
  3. Any unauthorized interception of data that occurs on WhatsApp’s network outside of MAJORITY’s controlled systems. 

7. General Provisions

We may terminate or suspend your ability to use the WhatsApp Channel at any time, in our sole discretion, without prior notice. Any translation of this Addendum or any communications provided by our automated systems in a language other than English is for convenience only. In the event of a legal dispute, the English versions shall control. This Addendum is governed by the laws of the State of Delaware, without regard to its conflict of law principles.

The MAJORITY Visa® Credit Card is issued by WebBank, member FDIC, pursuant to a license from VISA U.S.A. Inc. MAJORITY is not a bank or lender and is a technology company. Joining the waitlist does not constitute an application for credit and does not affect your eligibility or approval status. An application must be submitted to be considered for the card. Eligibility requirements apply, including but not limited to income and expense requirements, keeping your MAJORITY account in good standing, and establishing a security deposit account.


*Boost amount (i.e., the amount of the credit line increase) is up to 5% of the monthly on-time payment of at least the minimum payment due and is subject to other terms and conditions, including but not limited to an ability to repay check and a monthly cap in the credit card agreement.


**We report account information to one or more credit reporting agencies. Both positive and negative payment history impact your credit score. The impact of payment history on credit bureau scoring models will vary. Making on-time payments may help to build a credit profile for consumers without existing debt. Failure to make on-time payments will result in a negative history reported to credit reporting agencies and may negatively impact your credit score.
